PRIVACY POLICY
This Privacy Policy describes how MNBF, a Texas entity (“Company,” “we,” “us,” or “our”), collects, uses, discloses, and protects Personal Data in connection with its mobile application, website, application program and services, communication platform and support services, subscription services, and related features or services (collectively, the “Services”). This Privacy Policy is meant to comply with the Texas Data Privacy and Security Act (“TDPSA”) and other applicable U.S. laws.
1. Scope and Applicability
This Privacy Policy applies to Personal Data collected from individuals residing in the United States, including Texas, who access or use the Services. This Policy applies to information collected: (a) through the use of its Services, (b) through customer support communications; and (c) in connection with subscription billing and payment processing. This Policy does not apply to data collected in an employment context, a business-to-business context, or data collected from third-party websites or services not controlled by the Company.
2. Definitions
The following terms are defined as follows: (a) “Personal Data” means information that is linked or reasonably linkable to an identified or identifiable individual, (b) “Sensitive Data” means data defined as sensitive under the TDPSA and other applicable laws, including the precise location data and account login credentials, (c) “Processing” means any operation performed on Personal Data, including collection, storage, use, disclosure, or deletion, and (d) “Consumer” means “you,” the customer of our Services, provider of the Personal Data, and/or user of our application programs.
3. Categories of Personal Data Collected
The following categories of Personal Data may be collected, as follows: (1) “Personal Identification and Account Information” collected may include: (a) the full name of Consumer, (b) the email address of Consumer, (c) telephone number of Consumer, (d) a Username and password, (e) mailing address, and (f) service address; (2) “Home and Location Information” collected may include: (a) the physical address of the Consumer, and/or (b) the geolocation information of any computer or mobile device used by the Consumer; (3) “Subscription and Payment Information” collected may include: (a) subscription plan details, (b) billing history and transaction records, and (c) payment method type; (4) “Usage and Technical Data” collected may include: (a) IP address, (b) device and browser information, (c) application usage data, (d) log files and security data, and, (e) approximate location derived from IP address, and (5) “Communications” collected may include: (a) customer support inquiries, (b) emails, chats, and phone communications, and (c) documents or images voluntarily submitted by the Consumer.
The Company may also collect: (1) log and usage data for service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files (this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take or features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings)); (2) device data such as information about your computer, phone, tablet, or other device you use to access the Services (this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information), and (3) location data such as information about your device’s location (this location data depends on the type and settings of the device you use to access the Services, but could include GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address)).
The personal information that we collect depends on the context of your interactions with the Company and the Services, the choices you make, and the products and features you use. The Company automatically collects certain information when you visit, use, or navigate the Services. This information may not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.
The Consumer hereby grants the Company full access all unqualified permission to track location-based information from their mobile device, either continuously or while you are using our mobile application(s). If you wish to change our access or permissions, you may do so in your device’s settings. We may also request permission to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device’s settings. As part of our Services, we do not intend to collect audio recordings, video recordings, biometric data, or any continuously monitored household activity, unless consent is given and provided voluntarily by Consumer or requested in response to an incident, claim, or legal matter (filed or possible filing). We anticipate that payment card information will be, or is, processed by third-party PCI-compliant payment processors, and we do not store full payment card numbers.
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions. We may also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements, to tailor advertisements to your interests, or to send abandoned shopping cart reminders (depending on your communication preferences). These third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.
To the extent these online tracking technologies are deemed to be a “sale”/”sharing” (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below. The Consumer may “Opt-Out” of the collection of any of the above categories of information or data by notifying the Company in writing of such a request, using the following address for written notice.

By “opting out,” the Consumer understands that such a request may compromise the ability of the Company to provide the requested Services, and the Consumer assumes the responsibility for compromising the Company’s ability to provide Services to Consumer by their opt-out request submission without any reduction in charges and/or a reimbursement of costs or fees charged to the Consumer.
4. Data Collection, Retention, and Purposes of Processing
The Company will collect Personal Data directly from you when you create an account, subscribe, and/or contact us. The Company may also collect Personal Data when the Services are provided to the Consumer, including when the Consumer provides input communications to the Services (“Input”) or receives output communications from the Services based on the Input (“Output”). Input and Output are collectively referenced as “Content,” which Consumer agrees and acknowledges that Company will, to the greatest extent permitted by applicable law, possess and be granted all ownership rights thereto by the Consumer. Consumer hereby irrevocably assigns to Company all right, title, and interest, if any, the Consumer may have in and to said Input and Output Content to the Company, without the need to record said assignment or otherwise record the transfer of ownership in writing.
The Company will process your information to provide, improve, and administer our Services, communicate with you, improve security and fraud prevention, and to comply with the law, and the Company may also process your information for other purposes with your consent. Namely, the Consumer consents to the Company processing Personal Data for the following purposes: (1) to provide, operate, and maintain subscription-based Services, (2) to send alerts, notifications, and updates, (3) to process payments, renewals, cancellations, refunds, and account administration, (4) to provide customer support and respond to inquiries, (5) to improve service accuracy, reliability, and security, (6) to prevent fraud, misuse, or unauthorized access, and/or (7) to comply with applicable laws and enforce our Terms of Service. Sensitive Data is processed only as reasonably necessary to provide the Services or with your consent, as required by the TDPSA and other applicable laws.
5. Disclosure of Personal Data
By accepting the Services provided by the Company, you consent to the following disclosures of your Personal Data to the following persons/entities: (1) “Service Providers” – the Company has your authorization to disclose Personal Data to third-party service providers that perform services on our behalf, including cloud hosting, analytics, customer support, notification services, and payment processing, (2) “Legal Obligations” – the Company has your authorization to disclose Personal Data if required by law, regulation, subpoena, court order, or governmental request, and (3) “Business Transfers” – the Company may transfer your Personal Data in connection with a merger, acquisition, financing, or sale of Company assets. The Company does not control how third parties will interpret or use data shared under this Consumer consent and the Company makes no representations regarding third-party reliance on such data or their use of such data.
6. Data Retention and Data Security
The Company retains Personal Data for as long as reasonably necessary to: (a) provide the Services to Consumer, (b) comply with legal obligations, (c) resolve disputes; or (d) enforce agreements. You agree and authorize the Company to retain Personal Data as needed by the Company. The Company hereby notifies the Consumer that Personal Data may be overwritten, aggregated, or deleted in the ordinary course of business, and the Company does not retain data as a permanent record for any purpose, such as insurance, claims or legal purposes.
The Company will implement reasonable administrative, technical, and physical safeguards designed to protect Personal Data, which include security measures such as encryption, access controls, and secure communication protocols. Consumer agrees and acknowledges that no system is completely secure, and the Consumer understands and agrees that the Company cannot guarantee absolute security for Personal Data under all circumstances.
7. Consumer Rights Under the TDPSA and Other Applicable Laws
Consumers have the right to: (1) confirm whether we process their Personal Data, (2) access their Personal Data, (3) correct inaccuracies in their Personal Data, (4) delete Personal Data, subject to applicable exceptions, (5) obtain a portable copy of their Personal Data, and (6) opt out of certain processing activities, where applicable.
Requests to exercise privacy rights may be submitted using the contact information set forth herein. The Company may take reasonable steps to verify your identity before responding, and appeals of denied requests may be submitted as permitted by law.
The Company will not discriminate against consumers for exercising privacy rights. But, if You exercise one or more of these rights, you understand and agree that such a request may compromise the ability of the Company to provide the requested Services. The Consumer assumes the responsibility for compromising the Company’s ability to provide Services to Consumer by such an opt-out request without a reduction in charges and/or a reimbursement of costs or fees charged to the Consumer.
8. Children’s Privacy, Third Party Services, and No Sale of Personal Data
The Company’s Services are not directed to children under the age of 13, and the Company does not knowingly collect Personal Data from children under 13. The Services may include links to third-party websites or integrations, and you agree that we are not responsible for the privacy practices of the third parties supporting those links or webpages. The Company does not intend to sell Your Personal Data for monetary consideration, and the Company does not intend to engage in any targeted advertising based on Personal Data obtained through the Services.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time, and the Company will attempt to communicate any material changes to Consumers.
10. Consent and Sensitive Data Processing
Use of the Services is governed by our “Terms of Service,” which addresses subscription billing, service limitations, disclaimers, limitations of liability, and dispute resolution. In the event of a conflict, the Terms of Service control. By creating an account and using the Services, you consent to the collection and processing of Personal Data as described in this Privacy Policy and you Consent to all the terms and conditions set forth herein and in the Terms of Service. More particularly, by using the Company’s Services, you expressly consent to the collection and processing of all identified data set forth herein. If you do not wish to consent to the use of such data, you should cease all use of the Company’s Services.
